Liability Waiver

This Waiver explains circumstances under which you agree to release us from liability. It is incorporated by reference into the Terms of Service and Service Agreement.

You understand DMV processes inherently involve risks of delay, rejection, additional documentation requests, agency closures, and policy changes outside of our control.

NC Title Transfer Concierge is not affiliated with or endorsed by the North Carolina Division of Motor Vehicles (NCDMV). We cannot guarantee acceptance, timing, or outcomes of DMV filings. Responsibility for final determinations rests with NCDMV.

You are solely responsible for ensuring the accuracy and completeness of the information and documents you provide. We are not liable for errors, penalties, or rejections caused by incorrect, incomplete, or untimely information.

We may rely on third parties (e.g., couriers, notaries, payment processors, lienholders, shipping providers). We are not liable for delays, errors, losses, or failures caused by those third parties, except to the extent caused by our gross negligence or willful misconduct.

To the maximum extent permitted by law, you release and discharge Ottoform LLC d/b/a NC Title Transfer Concierge, its officers, employees, and agents from any claims, demands, damages, or causes of action arising out of or connected with your use of the services, except to the extent resulting from our gross negligence or willful misconduct.

You agree to indemnify, defend, and hold harmless NC Title Transfer Concierge and its personnel from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your information, documents, or use of the services, or your breach of this Waiver, the Terms of Service, applicable law, or third-party rights.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICES WILL NOT EXCEED THE AMOUNT OF SERVICE FEES YOU PAID US FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOSS OF USE, OR LOSS OF DATA.

This Waiver is governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Venue and jurisdiction lie exclusively in the state or federal courts located in Mecklenburg County, North Carolina, for any dispute with Ottoform LLC d/b/a NC Title Transfer Concierge.

If any provision of this Waiver is held invalid or unenforceable, the remainder will continue in full force and effect.

This Waiver, together with the Terms of Service and Service Agreement, constitutes the entire agreement between you and us regarding the subject matter of liability and supersedes prior or contemporaneous understandings on that subject.
